1. Acceptance of Terms

By accessing or using the AfriConsultancy website, job board platform, or any services provided by AfriConsultancy (Pty) Ltd ("AfriConsultancy", "we", "us", or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms in their entirety, you must not use our platform or services.

These Terms constitute a legally binding agreement between you and AfriConsultancy. We reserve the right to amend these Terms at any time. Continued use of our services following any amendment constitutes acceptance of the updated Terms.

2. Our Services

AfriConsultancy provides executive search, talent advisory, and recruitment services connecting organisations ("Employers") with professionals ("Candidates") across South Africa and the broader African continent. Our services include but are not limited to:

• Executive and senior-level talent search and placement
• Job listing publication and management via our online platform
• Candidate sourcing, screening, and assessment
• Talent advisory and market intelligence
• Bulk recruitment packages for high-volume hiring needs

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

3. Employer Obligations

By posting a vacancy or engaging our recruitment services, you as an Employer represent, warrant, and agree that:

• All job listings are genuine, accurate, and comply with applicable South African labour law, including the Employment Equity Act, Basic Conditions of Employment Act, and the Labour Relations Act.
• You have the authority to post vacancies on behalf of the organisation named in the listing.
• Job descriptions will not contain discriminatory, misleading, or unlawful content.
• You will not use candidate information obtained through our platform for any purpose other than the stated recruitment need.
• Payment for services rendered is due in accordance with the agreed fee structure and payment terms.
• You will treat all candidates fairly and without unfair discrimination as defined by applicable law.

4. Candidate Obligations

By registering, submitting an application, or using our platform as a Candidate, you agree that:

• All information provided, including CV, qualifications, and work history, is true, accurate, and complete.
• You consent to AfriConsultancy sharing your information with prospective employers for recruitment purposes.
• You will not submit applications for roles you are clearly unqualified for in bad faith.
• You understand that submission of an application does not guarantee an interview or placement.
• You will notify us promptly if you accept employment through another channel while being actively considered by an employer via our platform.

5. Intellectual Property

All content on the AfriConsultancy website and platform — including text, graphics, logos, icons, images, and software — is the exclusive property of AfriConsultancy or its content licensors and is protected by South African and international copyright law.

You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent. Limited use is permitted for personal, non-commercial purposes only, provided all intellectual property notices are retained.

6. Limitation of Liability

To the maximum extent permitted by applicable law, AfriConsultancy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our services.

AfriConsultancy does not guarantee the accuracy, completeness, or suitability of any job listing or candidate profile published on our platform. We act as an intermediary and are not party to the employment relationship between an Employer and Candidate.

7. 90-Day Performance Guarantee

AfriConsultancy offers a 90-day replacement guarantee on executive and senior placements, subject to the following conditions:

• The guarantee applies only to placements where full placement fees have been received by AfriConsultancy.
• The candidate must have resigned or been dismissed for performance-related reasons within 90 calendar days of their start date.
• The guarantee does not apply if the role, responsibilities, or remuneration package were materially altered after placement.
• The guarantee does not apply in cases of redundancy, restructuring, or business closure.
• Upon activation of the guarantee, AfriConsultancy will use reasonable efforts to identify and present a replacement candidate. No cash refund is provided under this guarantee.

8. Termination

We reserve the right to suspend or terminate your access to our platform and services at any time, without notice, if you breach these Terms or engage in conduct we deem harmful to other users, our reputation, or our business.

Employers may cancel a job listing at any time, however no refund will be issued for listing fees already paid where the listing has been published for more than 48 hours.

9. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts.

Before initiating legal proceedings, both parties agree to engage in good-faith mediation for a period of not less than 30 days.
